End User License Agreement

1. Acceptance of Terms

By downloading, installing, or using the Maplet mobile application (“App”), you agree to be bound by this End User License Agreement (“EULA”). If you do not agree to these terms, do not use the App.

2. License Grant

Subject to your compliance with this EULA, Gemshi (“Licensor”) grants you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on your personal iOS device
• Use the App for personal, non-commercial purposes
• Access the App’s features and functionality as intended

3. App Description

Maplet is a location management application that allows users to:

• Save and organize locations with notes, photos, and voice memos
• Create folders and categories for location management
• Track visited locations and travel history
• Open locations in various map applications
• Share locations and folders with others
• Sync data via iCloud (optional)
• Create journey plans and checklists (Pro features)

4. User Responsibilities

4.1 Acceptable Use

You agree to use the App only for lawful purposes and in accordance with this EULA. You must not:

• Use the App for any illegal or unauthorized purpose
• Attempt to reverse engineer, decompile, or disassemble the App
• Modify, adapt, or create derivative works of the App
• Remove or alter any copyright, trademark, or proprietary notices
• Use the App to transmit harmful, offensive, or inappropriate content
• Interfere with or disrupt the App’s functionality

4.2 Location Services

The App requires access to your device’s location services to function properly. You are responsible for:

• Granting appropriate location permissions
• Ensuring location data is accurate and up-to-date
• Using location features responsibly and safely

5. Privacy and Data

By using the App, you acknowledge that:

• Location data is processed locally on your device
• Personal data may be synced via iCloud if you enable this feature
• Anonymous analytics data may be collected for app improvement
• You are responsible for the content you create and share

6. Subscription and Payment Terms

6.1 Free Version

The App offers a free version with limited features. Free users can:

• Save up to 20 locations
• Access basic features and functionality
• Use iCloud sync (if enabled)

6.2 Pro Subscription

Pro features require a paid subscription:

• Unlimited location storage
• Journey checklists and planning tools
• Multi-stop route optimization
• Batch import/export functionality
• Advanced sharing options

6.3 Payment and Billing

• Subscriptions are billed through the App Store
• Monthly: $3.99/month with 7-day free trial
• Yearly: $29.99/year (38% savings)
• Subscriptions auto-renew unless cancelled
• Payment is processed by Apple, not Gemshi

6.4 Cancellation and Refunds

• Cancel anytime through App Store settings
• Refunds are subject to Apple’s App Store policies
• No refunds for partial subscription periods

7. Intellectual Property

The App and its content, including but not limited to software code, design, and user interface; graphics, logos, and visual elements; documentation and help content; and trade names and trademarks are owned by Gemshi and protected by copyright, trademark, and other intellectual property laws.

8. Disclaimers

The App is provided “as is” without warranties of any kind, either express or implied. Gemshi disclaims all warranties, including but not limited to:

• Warranties of merchantability and fitness for a particular purpose
• Warranties that the App will be error-free or uninterrupted
• Warranties regarding the accuracy of location data
• Warranties that defects will be corrected

9. Limitation of Liability

To the maximum extent permitted by law, Gemshi shall not be liable for:

• Any indirect, incidental, special, or consequential damages
• Loss of profits, data, or business opportunities
• Damages resulting from use or inability to use the App
• Damages caused by third-party services or content

In no event shall Gemshi’s total liability exceed the amount paid by you for the App or subscription.

10. Third-Party Services

The App may integrate with or link to third-party services, including:

• Apple Maps, Google Maps, Waze, and other navigation apps
• iCloud for data synchronization
• Firebase for analytics and crash reporting

These services are subject to their own terms of service and privacy policies. Gemshi is not responsible for the content or practices of third-party services.

11. Termination

11.1 By You

You may terminate this license at any time by deleting the App from your device, discontinuing use of the App, or cancelling your subscription (if applicable).

11.2 By Licensor

Gemshi may terminate this license if you violate any terms of this EULA, engage in fraudulent or illegal activities, or fail to pay subscription fees (if applicable).

11.3 Effect of Termination

• Your right to use the App ceases immediately
• You must delete the App from your device
• Subscription access will end (if applicable)
• Local data may remain on your device until manually deleted

12. Updates and Modifications

Gemshi may update the App and this EULA from time to time. Updates may include new features and functionality, bug fixes and performance improvements, security enhancements, and changes to terms and conditions. Continued use of the App after updates constitutes acceptance of the new terms.

13. Governing Law

This EULA is governed by and construed in accordance with the laws of the jurisdiction where Gemshi operates, without regard to conflict of law principles.

14. Severability

If any provision of this EULA is found to be unenforceable or invalid, the remaining provisions will continue in full force and effect.

15. Entire Agreement

This EULA, together with the Privacy Policy, constitutes the entire agreement between you and Gemshi regarding the App and supersedes all prior agreements and understandings.
